The important distinction
The website introduces our business and services. It does not replace property particulars, professional advice, identity checks, a tenancy agreement, an agency agreement, a memorandum of sale, an ARO agreement or any other signed contract.
1. About these terms
This website is operated by Dockland Estates Ltd, trading as Dagenham Estates, registered in England and Wales under company number 12610580.
Our trading address is 425 Becontree Avenue, Dagenham, RM8 3UH. You can contact us at info@dagenhamestates.co.uk or on 0208 597 7834.
By using this website, you agree to these terms. If you do not agree, please stop using the website. Where separate written service terms conflict with these website terms, the specific written service terms take priority for that service.
2. Using this website
You may use the website for lawful personal or business property enquiries. You must not:
- use the website fraudulently, unlawfully or to harm another person;
- attempt to gain unauthorised access to the website, server, accounts or data;
- introduce malware, automated scraping, excessive traffic or other disruptive technology;
- copy, republish or commercially exploit our content, branding, photographs or data without permission;
- submit false, misleading, abusive, defamatory or infringing material through a form.
We may block or restrict access where reasonably necessary to protect the website, our customers, our systems or third parties.
3. Property listings and information
Property descriptions, measurements, floorplans, photographs, prices, rents, availability, tenure, council tax, service charges, lease information, utilities, planning information and other particulars are provided in good faith for general guidance.
We take reasonable care to present material information accurately and to correct known errors. Information may, however, come from sellers, landlords, developers, managing agents, public records or other third parties and may change without notice. Images may use wide-angle photography, and plans or measurements may be approximate.
You should inspect the property and ask us about anything important to your decision. Buyers, tenants, landlords and sellers should obtain appropriate legal, survey, valuation, mortgage, tax, planning, building-safety or other professional advice before committing.
A listing is not an offer or contractual promise. A property remains subject to availability, contract, satisfactory checks and the instructions of the seller or landlord.
Viewings, applications and offers
A viewing request is not confirmed until we accept it. We may need to verify identity, contact details, financial position or other relevant information. Offers and applications may be passed to the seller or landlord but remain subject to their decision, contract, referencing, affordability, right-to-rent and any other required checks.
4. Our services, instructions and fees
We provide property sales, lettings, management, maintenance coordination, compliance support, valuations, buyer-finding, landlord services and related property assistance. Availability and scope depend on the property, location, instruction and agreed written terms.
Website descriptions are summaries. Before we act for you, we may provide separate written terms setting out the service, authority, fees, VAT, expenses, minimum periods, cancellation rights, responsibilities, complaints process and termination arrangements. You should read those terms before signing.
Fees displayed online are subject to the stated conditions and may be updated. A change will not retrospectively alter a binding written agreement unless that agreement lawfully permits the change.
Third-party services
We may introduce or coordinate solicitors, mortgage brokers, insurers, contractors, inventory providers, referencing services, surveyors or other suppliers. Unless we expressly agree otherwise in writing, those suppliers provide their services under their own terms and remain responsible for their work. We will disclose referral arrangements where required.
5. Valuations, calculators and online results
Instant valuations, rental estimates, yield figures, ARO calculations and other online outputs are indicative only. They may rely on assumptions, user-entered figures, market data and automated calculations.
They are not a formal valuation, survey, mortgage offer, regulated financial advice, guarantee of sale or rent, commitment to advance funds, or binding offer from us. Actual figures and eligibility may depend on inspection, title, tenancy, condition, location, demand, risk, due diligence and signed terms.
6. Specialist, legal and maintenance content
Possession and compliance information
Website information about notices, possession, eviction, licensing, deposits, safety, Right to Rent or landlord compliance is general information only. Property law and procedure can change and depend heavily on the facts. Nothing on the website is legal advice, and no solicitor-client relationship is created.
Do not serve a notice, withhold funds, enter a property, remove belongings or begin proceedings solely on the basis of website content. Obtain case-specific advice and use the correct current documents and procedure.
Maintenance reports and emergencies
Submitting a maintenance report does not itself confirm attendance time, contractor appointment or responsibility for the repair. We will assess and progress reports in line with the tenancy, our management authority, urgency, access and available contractors.
Website forms must not be relied upon for an immediate threat to life or property. In an emergency, contact the appropriate emergency service or utility provider. If you smell gas, call the National Gas Emergency Service on 0800 111 999.
7. Availability and liability
We aim to keep the website available, secure and accurate, but we do not guarantee uninterrupted access or that every item will always be complete, current or error-free. We may suspend, withdraw or change any part of the website where reasonably necessary.
To the fullest extent permitted by law, we are not responsible for losses caused solely by reliance on general website information where the need for independent verification or professional advice was clear, or for events outside our reasonable control.
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing affects rights that consumers cannot lawfully waive under the Consumer Rights Act 2015 or other applicable law.
8. Complaints and redress
Please contact us first so that we can investigate and try to resolve a concern. Write to info@dagenhamestates.co.uk or to Dagenham Estates, 425 Becontree Avenue, Dagenham, RM8 3UH.
Where a complaint falls within an approved property redress scheme and remains unresolved after our internal process, eligible customers may refer it to the relevant scheme in accordance with that scheme’s rules. Details of our applicable redress and client-money-protection arrangements are available from our office and should also be displayed on the website where legally required.
Complaints about our use of personal information are handled under our Privacy Policy.
9. Intellectual property, links and general terms
Intellectual property
Unless stated otherwise, the website design, wording, branding, graphics, photographs, videos, databases and other content are owned by or licensed to us. You may view and print reasonable extracts for personal property-search or instruction purposes. Other copying or commercial use requires prior written consent.
External links
Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content, security, availability or privacy practices. A link does not necessarily amount to endorsement.
Privacy
Our Privacy Policy explains how we use personal information and cookies.
Changes to these terms
We may update these terms to reflect changes to the website, our services or the law. The latest version applies from the date shown at the top of this page.
Severability and waiver
If a court finds part of these terms unlawful or unenforceable, the remaining terms continue to apply. A delay in enforcing a right does not waive that right.
Governing law
These website terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, except that a consumer resident elsewhere in the United Kingdom may also have rights to bring proceedings in their home jurisdiction.
